Very Upset...

I'm feeling extremely upset. Another skinner from this site (you know who you are) stole one of my graphics from my "Blue Pearl" skin and is using it. I'm not sure what to do. I don't want to say any names, just looking for advice on the matter.

I would never make such a controversial statement unless I was 100% sure. I have taken and reproduced the stolen graphic many times, the pixel pattern is almost exact, it can be reproduced quite easily with just using layer styles in Photoshop.

What can I do?

It should say something to you that not one person who has examined this case agrees that you have been ripped Zodiaq. Will you at least accept that there is a possibility you're wrong about this?

So, another skinner you have chosen, pjpowell, is ignored too. He went to great length examining these buttons. Again you do not respect his opnion.

It may not be clear to you yet, but by going public people will invest time in you. Maybe you find these people incompetent, but you have chosen these people to give a judgement. And like grayhaze points out all these people come to the same conclusion.

Do not do this to yourself, man. You can go back before the end of the thread.

Jafo...I don't think those images are a fair assesment. Take my button, cut the top half, stretch, copy, flip vertical, overlay, or saturation, or softlight and change the opacity. It's not just a likeness.

Holy cow! what is this all about. Ive been following this thread cause I was curios, and I took a look at Zodiac's button in question. That button can be re-produced with any number of glass or bevel filters that zillions of people may have in thier graphic programs. Because it was made by you Zodiac, does that make it yours? Should other people now be afraid of making something that too closely resembles a piece of someone elses skin? I would say yes if it had a unique quality or a logo on it or somthing but A button is a button is a button... Especially a GLASS button.

Can someone delete all the skins on this site because they're rips. They all use colors in the same visual spectrum as my skins.

ah, you know I question if you *can* rip such a common thing as a pill shaped button?

I mean heck there has to be at least 20 jpg/gif button creation applications on the web that use this as the standard GEL or Candy button shape, and that goes for the colors also.

I just emailed Jafo cuz now I'm worried my latest skin might be considered a rip. I don't even know what a rip is exactly so that's why I bothered the poor guy but I have and ALWAYS have made all my own graphics from scratch (wish I could add the sniff)...the only thing in this one instance was a similar shape so I'm waiting on Jafo's 'go-head' on the matter. Better safe than sorry.

I can hear someone laughing now..."If 'round' is a shape...if 'square' is a shape' then we're all rippers."

Okay, call me paranoid. hehe

OMG!!! You guys...This is too much.

Plain and simple. I agree their are several graphics on several skins that may be similar, maybe used as a reference to create something close. For hell's sake, someone could use the same tutorial.

The button I created was created from scratch using Photoshop layer styles, I didn't use any tutorial and spent a lot of time on it.

I'm not saying it was recreated as a likeness. What I am saying is that it was my file cut and pasted and modified.

I emailed the author earlier today but have received no response as of yet. I wish I could at least hear his side of the story.

Zodiac, I looked at the images and also had to say that I didn't see anything like you're saying. Do you zoom into pixels when you analyze them? That might help. But I must ask you point blank (for the sake of all sanity involved here)...did you ACTUALLY slice your own image in half...copy paste it and get the exact effect you're speaking of? That might clear everything up right here. I understand you're being upset and nobody is dissing you here...in fact quite the opppostite...we want you to stay and not feel that you are being mistreated or not 'heard' but many folks including myself looked in depth at the pixels and found no fault or foul.

If you must cut, paste, and apply multiple filters to your image, to get his. Sorry Zodiaq, this is no "proof" at all. Please drop this, and skin something.

Zodiaq~...I have emailed you a 'private' response and [I hope] clarification.

Putting these images on public view for comment has meant you don't need my sole opinion of whether there is an incidence of 'ripping' or not, as you have others with an equally qualified/experienced opinion of the issue at hand, seemingly concurring with mine.

I'll show you a real-life issue of ripping which actually took a lot of argument for those concerned to be convinced.

This is a rip which was claimed NOT to be, yet very definitely IS such......and an example why your situation is really so different...

This is pointless

This is my final comment:

Like I said earlier, I have many hours into a skin that I intend to share with many of the users that appreciate my work. I will release it perhaps sometime next week and leave it up, as well as the rest of my library for a couple of weeks.

Regretfully, after that I must pull out from Wincustomize. I'm not looking for sympathy or please don't go, I don't want any of it. After all, I am just some guy that puts together a few graphics and calls it a skin. I mean in all reality, after the first 30 minutes of my departure I won't even be remembered, so it's really not that big of a deal.

I feel that I approached this scenario the best I could and frankly, most of the responses in this thread are quite Rude. As other's have been very rude towards many other skinners and artists on this message board and driven them away.

Jafo's comment on manipulating a cat into a dog was uncalled for and clearly a statement as such is the kind of fuel that has fed the fire's of some of the very hateful threads in the past month or so and it's coming from an admin.

I am leaving with no ill feeling's...I promise

I enjoyed it while it lasted, it was vey fun.

Now, the small image on the left is a 256 colour gif claimed to be the sole inspiration to the creation of a work which was argued NOT to be a rip of the Universe Metal Wincustomize.com site skin....as if the two images/designs were some-how a magic coincidence?

I don't think so.

The IE6 browser window on the right shows the WC skin in action.

Except for colour-depth restrictions of a gif format [256 colour] Vs the jpg's 16.7 million...they are pixel-perfect.

And yet I defy anyone with working sight and an above-drool-level intelligence to conclude anything BUT that they are identical and therefore a 'rip' issue....

Zodiaq~...my comment about manipulating a dog to make a cat was a humorous [in theory] example to explain that if an image must have so very many alterations/processes done to it before it is like another then it clearly is not actually like it in the first place.

A dog has 4 legs and a tail....so does a cat, yet a cat is not a dog.

Your image CAN be made to look like his, and vise versa.....I agree thoroughly, but so can so many others that this cannot realistically be construed as a rip.  If it is, then ALL, that is ALL 'glassy' buttons are a rip of the Apple OS.

This is not a defensible and upholdable claim via copyright, though I believe Apple was trying to.  I think it was like trying to copyright an apple without the bite removed....just too publicly generic...but WITH the bite removed it was distinguishable and registerable.

In the same way that Macca's has trademarked its 'M' symbol....doesn't mean it has trademarked the letter 'M'...

Not a rip, the one has a blue satin in the middel and a brighter light, also on the bottom.

I've seen things that came MUCH closer to my crappy x-box skin.

If people have been rude, I think it's because of the fact that you're going to leave the community simply because Jafo and others disagree that it's a rip. Maybe it's me, but that seems rather childish, especially for something as little and common as a round Aqua-like button.
People leave over the silliest ideas.
