I'm ashamed of my people - he didn't even bother to change the text in the wp.

This is iffy.

I think the guy was fine for posting, since it is a screenshot site there is no implication that he made it. What is ethically wrong is that he didn't actually post a screenshot, i.e. a shot with icons, a taskbar, etc., that no one could just save and reuse. Also, he didn't credit D, though he could have just assumed that since the wallpaper itself has a credit line, he wasn't really hiding anything.

Not good, but not evil. The site should make sure people don't upload wallpapers as screenshots.

Yes, but that site has two sections, one for screen shots of your desktop, and one for wallpapers. And that tank was uploaded to, and found in, the wallpaper section

Ah, sorry. The address was "snaps/desktop/1048927118.jpg" I assumed it was a screenshot. Odd way to name a directory for wallpapers.

OK...now I'm getting angry....rejected again....looks like I have to join up on another crappy site yet again just so I can chew their collective ears out about theft and criminal action.
I'm a member of so many pissy little theft-sites it's beyond a joke.

This image, [Wallpaper] is the property of Russ Schwenkler [Dangeruss], and
not of the person submitting the work to this site.
Redistribution of an artwork without specific permission is copyright theft.

Below is my standard email, used in situations such as this....

It appears that you are displaying numerous wallpaper images and skins on
your site originally created by authors other than yourself.
Although images are freely available for download on the Internet, they are
EXPRESSLY for personal use, which does not include the reproduction and
redistribution of them via another site such as yours.
The modification, and/or re-distribution of an artist's images without
his/her express permission is in violation of the Artist's Copyright, and is
pursuable in law.

Whether these images link to the original artist's site or not, or whether
the Original artist is credited or not, without prior permission to display
such, you are in violation of inherent and/or expressed copyright.

I strongly suggest you remove any such images for which you do not have
permission to display via verification of aurthor, and minimize the
potential for litigation against you and subsequent claims for loss.

I await your favourable response.

He did upload it as a screen shot too.http://www.macsnaps.com/view.php?type=screengrab&id=64&clear=1050535115

But the first is a violation >

elvee....both are in violation, if the screenshot is not sufficiently obscured to prevent the wall's download unscathed...that is again 'redistribution' without permission, not 'fair-use'...

elvee...see if you can get to 'mac15's' email contact...he claims to be an admin so the rocket should be aimed up his butt, no-one else's, since he upped the image.
If you can/do, could you post this email to him on my/our behalf?

Copyright theft and abuse.
