If you really want to be pedantic about the car example, they effectively took the car from the car park where the owner had it and put it in their own car park for their friends to look at, and where the owner would have no idea of its location. In that case you could still say the car didn't leave the planet, just as you have said the wallpaper didn't leave the internet.

They also gave free rides in that Ferrari to all their friends without telling them it was a stolen vehicle. Who knows how many people currently have that wallpaper on their Mac desktop thinking it was made by a person called 'Devianart.com'? You can't really blame them for not knowing, but you can make damn sure they're informed of the crime their 'friend' has made them a part of.

Going in with screams of rip which weren't true were unfair. He did not rip, he only posted a piece of artwork by another author without consent.

YouJi...if it were a screenshot of a desktop that just happened to have Russ's tank on it....partly obscured by icons and other 'junk' it would have been 'fair-use' and quite legal.

The mechanics of the Internet is that generally if you can see an image you can download a copy of it in one form or another and it's on your hard-drive, from a source unauthorised by the original artist, and most usually without any form of genuine credit to its origin and author.

That wall being made available for download means the Ferrari was actually no longer in the car lot, and not only that, the compliance plate was removed along with the number plates.

If mac15 had asked I think it's a safe bet that Dangeruss would have chucked him the keys and said 'sure, take it for a spin and show your friends....scratch it and you buy me another'...and that would be that.


But it wasn't....

I know all that. No, it's not right, and no one should stop fighting. I think I mentioned that in one of my posts. Thing is, there're too many factors that play into too many things. Should capital punishment have been used on a child who killed? Capital punishment is used on adults who killed.

Same crime, murder, but different results/punishment.

However, I believe every indivdual is different, and you treat all situations differently with one common goal: to bring this person to an understanding that once may be forgivable, but the second time may cause him/her to gain a bit of pain.

I'm not trying to cut Dangeruss's credit in half, oh no... I would never have thought of it. I, however, see it as a piece of work admired/liked by many others... and it adds to Dangeruss's accomplishments, however wrongly the appreciation was carried out.

Good work wouldn't be stolen, but stealing isn't right either. How many good artists do you know face up against stolen work all the time? I'm sure all of you who have shared your opinions have. Now, you're good enough people want to copy you. That to me is a small compliment, but a wrong way to present a compliment.

In this case, I prefer to have people go gentle. If they're just morons who steal for fun, hey, be my guest, unleash the wrath of all artists out there on them. Skin them alive, boil them in oil, I'm sure the Chinese have some books out there describing the ways of torture you can perform.

Are you suggesting that a child who killed should just be slapped on the wrist and sent on his way until the next time he killed, at which point we should hurt him? Hmmm...

O.K., I have reached the conclusion that you are completely oblivious to anything anyone is saying to you, so, I will not post anything else in this thread. Suffice to say, if anyone uses my work in the same way, I will chase them down, and if necessary, I will sue them for breach of copyright. I have the financial resources to do so, and I would not lose the suit.
The operative words here are "my works", mine, they belong to me, I created them, I will decide what happens to them, where they are posted, and what they are used for. Simple!. The methods we use to protect our work are irrelevant in this case, about as irrelevant as you "murder" analogy. You constantly contradict yourself in all your posts, so, if you don't know what you mean, how can you possibly expect the rest of us to respect your contradictory opinions? Sheesh!

Not to my knowledge moshi. I think the majority of known cases of ripping are solved by the methods we're talking about. It's only a matter of time though before someone with the monetary resources to do so skips the polite stage and just issues someone with a lawsuit.

I've been saying, let the author take her stand first before everyone else jump in. If the author decide to "flame" him, her friends can feel free to do the same. If she doesn't want to bother with it, then that's her business.

Okay, I got my books, I'm out of here. I'll probably not be back too often. One and a half weeks to go before school is out for me. That means finals. Have a good time.

it would be good for the whole scene if there would be such a lawsuit, doubt it will ever happen though (been "a matter of times" since years).
maybe Apple will sue some skin sites one day.

How many times does it take Youji? Nobody did any 'flaming'. That's just another misleading term like 'rip' anyway. 'Flaming' is generally taken to mean throwing personal insults at someone on a public message board without just cause. No such insults were made.

The only messages posted on that site were valid claims of theft, and requests to remove the offending item. Obviously some people were a little better in their wording than others, but nobody resorted to the kind of childishness that would constitute 'flaming'. The only person who claims such tactics were used is the person who posted the offending wallpaper, and then subsequently went on to DeviantArt to try and save face by attacking Jafo's character.

I suggest you stop talking about this now, as you clearly have no grasp of the facts and are unwilling to listen to those who were there to see the events unfold. You obviously have some warped picture in your mind of how the whole thing went and are unwilling to have that picture corrected by anyone.

i always wondered about free fonts that are distributed in "exclusive" pay suites. i´m sure there are permissions for that, but i never see any credits and the original readmes have been removed. have to mail Craig Kroeger and ask him what he thinks about this or if he cares at all.

Sorry if I kept using the word flame. I did go back and re-read what Jafo had posted. Yeah, sorry there was no flaming involved. Sorry for accusing so much.

I still stand by letting the original author warning the offender first though and one or two other things, but those aren't important.

I have another class at 1:30. I'm going to leave now and I'll probably be gone for a while. I have lots of finals and I need to start studying for them.

Jafo was waiting for reality to bite....the biggest insult was the accusation of a lack of professionalism or 'flaming' which was unwarranted.

As to whether the author should have first 'go' at complaining or not, perhaps seek the author's opinion...what is better? Prompt removal to minimize damage or wait an indeterminate time to shut the door after the horse has bolted?

As baker said, it 'can't be reasoned out'.

Just be aware that the policy is prompt response, and it will not change.
