OK...looks like 'communication' is beginning to work...
If and when the Windowblind is altered to remove the Skins Factory images it will be OK.
However it still will NOT be OK to release under GNU. To do that you MUST have consent from the Icon artist agreeing to his work being released under GNU.
This is VERY DIFFERENT from normal permissions....because the released rights are VERY different.
IF you then do release something under GNU then a copy of the actual Licence Agreement...the GNU Licence MUST be included with the skin.
You 'shouldn't' NEED to release a skin under GNU. All you need is to upload it as everyone else does....and just include a Permission.txt file showing consent for anything included that is not your own....

But I don't get something - we already have stuff here that is copyrighted and was allowed as "fan art" so how come he needs permission??

Kona, the only permission he needed was from D Araenz, and The Skins Factory. He has permission fron Arnaez, he didn't get permission from the TSF. He said he would replace the images he used that belong to TSF. That's all he needs to do.
But English clearly isn't his first language, and I don't think he fully understands.

WinCustomize actually does allow fan art here. You can't re-distribute copyrighted wallpapers but you can create your own fan art and upload.

After taking a close look at the skin (preview) I just realize that you'll need two permissions;
1- Permission from The Skin Factory since you have uses a lot (if not all) of the images from their Batman Begins Windows Media Player skin to create your WB skin.
2- Permission from D. Arnaes for the use of his icons on your shell images

That is not my full own making then I am sorry to you and sent a email to your The Skins Factory user email address and he not permission me him Batman Begins WMP 10 skin some image use (I am only 2 Image use for Batman Begins WMP 10 skin).
But I have permission D. Arnaes for the use of his 2 icons on the shell images.

My suggestion is to take the time and redo the theme with your own images. It will look better and you will have the satisfaction of knowing that you actually created something on your own.
