I'm not going to comment on whether I think it is a rip or not. Back's is a photo manipulation. Cat's looks like it's the original photo (or slightly manipulated). So the real question is, where did the original photo come from.

Maybe it is a good idea to mail the artists involved and/or the admins first before going public. Just in case. Sometimes artists have different nicks on various sites.

That picture comes from a ComStock Photo CD or at least it's really close to one I've seen on it.

The image in DeviantART has a link to Misanthropia.com on the bottom right corner. The artist of that and other manipulated images is ~back.
If Back is using the nickname cat925 to upload work in WinCustomize, why would the image be uploaded here cutting out the bottom part?
