and a rip report

Friday, May 23, 2003 by moshi | Discussion: WinCustomize Talk

in a recent thread i had to read the following: "moshi Where is this LCARS interface then? Oh yeah it fictional, and only exists on a tv show! At least i've made it reality or closer than eney one else has! You try and make a theme that complex."

i was pretty surprised as all the images in this theme looked very familiar. a few years ago i was really interested in emulating the LCARS interface and i have seen all of those before...

as the use of trademarked logos is allowed at Wincustomize (the guidelines speak of "theoretical copyrights" - whatever that may be) we should not discuss about those, but rather about the ordinary theft we all can agree about.

i am speaking about this theme: https://www.wincustomize.com/window.asp?Cmd=COMMENTS&Lib=3&SkinID=2445

download it and have a look at mainback 2.BMP

it contains a resized, cut and pasted rip of this image: http://www.lcarscom.net/images/galaxy.jpg at lcarscom.net. even the link is still there, but resized to be unreadable.

personally i think that nothing that is more complicated than black text on a uni-colored background and vice versa was created by the skinner. but it is not my job to search every single rip in this theme. one is already one too much, right?

I would love to know how you are so sure that the image from Lcars.com and the one Adam used are exactly the same?

Urlryn - did you check out the links and the image moshi pointed to? I have, and the lcars.net image when resized to fit Adam's mainback2 image, lines up perfectly. The distorted link text lines up too. No one is saying Adam didn't work hard on the theme, but he MUST have written permission to use this image.  The fact that this one image was 'borrowed', makes all the images seem suspect.

Do all these Star Trek sites show us they have written permission from Roddenbury and/or the right holders for each of the movies/tv shows that give all the websites permission to hand out thier images as if they own them? I doubt it.

I doubt it too, but we don't control those sites.

Besides, short of a mystical experience or a seance, I don't think Roddenbury is in any condition to give his permission.

My thinking is that when a graphic used in a work actually has the original site's link within said graphic it really would be wise to actually seek and obtain permission from that site to use that graphic.

If I were to use an image in a LS theme that had 'Lcars.net' on it I'd be assuming the image was probably made by or for that site and therefore they would need contacting for permission for its use.

Since this image of concern exists on another's site and is therefore not the property of the person who submitted it here [irrespective of how complex or altered the resulting work might be], and there is no accompanying 'permission.txt' covering its use, the work must needs be removed from public access pending appropriate correction/s.

It is generally a simple process to seek and obtain suitable consent/s to make use of another's images/content....people do it every day.  Some, unfortunately [like myself] are stuck permanently in stasis waiting for approval because a person may be difficult to contact...I'm still twiddling thumbs 6 months later, but there is no way I'll be side-stepping the consent issue.

I expect this particular 'issue' will be resolved.....[but I'd like to think it does NOT merely be displaced to an alternate skin site where standards may be more 'lax']...
