WHAT is a RIP?

Monday, December 10, 2001 by John Hamp | Discussion: WinCustomize Talk

So what exactly is a rip? I'm getting into how to create my own skins and what is the threshold? Can you use someone elses graphics, modify them and then include in the readme credit for the original? Or is that taboo? Where do you draw the line?

This may sound picky, but the difference between a rip and warez is claiming authorship. And I usually apply warez to software exclusively.

...crae is right about the warez, but you make a very good point about the concept of 'ripping'!!!

Lots of people upload other people's skins and "give credit". That is still a rip.

Come off it. I don't really care if you're saying "oh, this is in fact someone else's stuff, I'm just using it", or you're claiming it's your own work. It's *still* theft. It's using someone's work in a way they may not have intended. I'd certainly get really pissed if someone took my skins and ported them to, say, .msstyles, without asking. If anyone gets to do that, it's me. That's one of the conditions under which I released it in the first place.

Honestly, this seems so obvious to me it's hard to explain - the person who made it gets to say what other people do with it. If someone does something with it that I, personally, have not agreed to, it is a rip and illegal. Is it that hard a concept to understand, that people have certain rights, and just because they give it away, they don't lose those rights?

Anyone that works in advertising would know about copyright laws and ownership of imagry. Anything that you "create" holds an automatic copyright by the author of such material and can not be used in any way shape or form regardless if it is for profit or not. This applys to modification of logos as well, i.e.The Microsoft logo is their property and must be displayed and used in compliance with their licensing agreement and be approved by them before publication. Unless the author of the materials gives expressed written permission for the use of their materials by others it is protected by their copyright and have legal recourse against those that steal or "rip" their work without such permission. So to answer your question Hamster, if you want to use or modify someone elses work, be kind and send an email to them requesting to use their artwork in your creation, only use their work if they give you permission. It is not enough just to mention them in a read me, permission must be recieved.

Working in Architecture as I have been for 30 years, the prospect of theft of copyright of designs/drawings is very real. Compensation for the potential for financial loss can and has been upheld in court....the 'ripper' being forced to pay 'loss of profits' to the original company....in one case that I recall, that was $60,000 plus costs.
If and when copyright proprietorship is pursued in court it's the 'ripper' that gets hurt, well and good...
