I just find out that the latest version of Windows XP (build 2485), have took my "XP Wallpaper" and they change it with slightest modifications, to monochrome blue, without any notice or permission.
I am attaching a screen shot for you to see it.

Hum, OK, I see what you mean.
I looked at your WP and Microsoft's XP wallpaper, and I'm sorry but although it is similar, there are enough differences to attribute the resemblance to coincidence. After all, the curves in the wallpaper is based on their logo (the Windows flag). So, I'm sorry to say I do not perspnnaly believe they riped you.
But I understand your concern though.

Those "curves" and the logo is another thing (exist for two months, maybe more) and the IDEA of making the logo perspective in all the screen, in my way, is another.
It is my idea who makes this wallpaper so successful and Microsoft interesting for that.
I am proud for that, but not even a "Thank you" ?

umm...welll, in a way, I really can't say that there is anything wrong with it, even if they did rip it off of you. After all, you took the general idea from them.

Actually, as often as "skinners" rip MS's interface's and such, why should they see anything wrong with ripping off the skinners? It really is a two way street. (no, that particular comment was not directed at any specific person, but to all skinners who have ripped MS's OS interfaces).

Read the whole statement to see in what context those few words were stated.

No, I don't _believe_ it is OK to rip anyone's work. That includes graphics work included in software packages...ie: winXP, Luna, ME, Aqua, QNX, BeOS, and whatever other gui's "skinners" like to make 20,000,000 copies of.

Like I said, it's a two way street.

When did you first post that wallpaper? I've seen screenshots of builds of XP that people are grabbing from the NewsGropus for a while now that have had that wallpaper. Since like way back April from what I can recall...

give me a break... it's not even close. I had to do some searching to find both walls but I was curious.

adni18 - sorry but the only similarity is that it's a tilted logo. Tilting is not protected by copyright laws The MS wall quite obviously does not have any of your image in it.

I noticed someone else already ripped the MS wall... jeesh - that didn't take long. Why don't you guys do some original works without lifting stuff from existing art and modifying it

i spend a lot of hours trying to create this wallpaper and of course i know the date i make it.
This replica appears out, few days ago. It is nice, but the idea arise, after my wallpaper spread around with big success. Until now all the beta versions, did not include this one.
Do you think is coincidence ?

Hey adni18. Did you get permission from MS to use their logo or their products name? I don't see any permission in your description of your file or in a zip file.

The whole XP - Aqua OSX - etc. issue starts flaming threads for obvious reasons. When an "art" site gets inundated with posts that include logos, backgrounds and images that are copyrighted a lot of people get upset.

Please, let's not go into that again here. The XP craze has generated many skins and wallpapers that use Microsoft's images. The wallpapers that have MS wallpapers lifted from the software are definitly not appropriate here. There are still several which should be exiled like xpfreak's stuff that is right out of the box. Skins that are porting the look have their place and their following of adoring fans. I can accept that. Making walls that compliment the look makes sense too for the folks that want an XP look. Why you would want to put the MS logo on it is a mystery to me but I guess it's a very popular idea.

Fact is, MS' logo is used illegally and could become an issue with them. If it did, they would notify the admins here that they were upset about it and all the MS stuff would disappear. Meanwhile, it's a compliment to them that so many people are making MS backgrounds and that they are so popular.

As far as the two walls in question here, you can easily compare them because digitaljames' rip of the actual MS wallpaper is right above adni18's wall in the wallpaper section. I don't see where they are even similar except that the MS one has a tilted logo (more 3D, more wave in it, more depth, different angle, etc.) The logo being the central image, OF COURSE there is a similarity in the two pieces. The similarity is the presence of the Microsoft Windows logo.

That's immaterial. It's still a rip. It's their graphics. You ripped them, they may (who knows, someone could have had something similar and never included it,or not) and they ripped you. All's fair in love and war.

p.s. I hope you unchecked the option that allows it be packaged in the WinCust CD.

p.s.s. Why would you be surprised that MS ripped something from someone. Apple's lawyers could tell you that they have been doing it for years. he he.

You have right and i'll agree with you with everything you write above, except the similarity.
If i have post it, (the Microsoft's wallpaper), yesterday, i am sure all of you will say : adni18 makes always somewhat similar wallpapers.
And this is all i am trying to say, with my poor English.
