Firstly, if that URL details public release/distribution rights [NOT just 'private use'] then that always helps.
However, the 'Simpsons' Logon was 'moderated' with no consideration as to whether there was permission or not.

Basically, if you didn't make the image or any parts of the image, you can't upload it anywhere without having the express written permission of the person that actually made the image or images you are using.
If you do have permission, it must be included with your upload.

You can upload without permission too. The problem being it won't be accepted.

According to Jafo, if this is the Logon you are referring to, permission doesn't matter. It was rejected.
If there are others, that require permission then, in order to get them actually considered, you will need permission. Although, they may still be rejected. (Example: all Britney Spears or Dolphin material will likely be rejected, regardless of permission.)

It won't be....not until you can show you have author's consent for any images used....
...and even then it's unlikely to as wallpapers, logons and bootskins are subject to moderation, which means not all are accepted.
