But my ? is, If you buy 10 cds, make a single backup of each..SAomeone breaks into your house and steals the originals..Now all you have is the copy correct..So Now you are a crimminal also...That sounds like pretty shakeyground to me..as in Im in that catagory now..I paid for the rights to own that cd..the original was stolen, now the theif is tecnically the legal owner ..provided he never gets caught...or there is suffecient proof to prosocute him....also did you know that every record shop that sells and buys USED cds never gives money to the original artist for said transactin....The artist only gets money when a new batch of cds is ordered by Oh lets say Sam Goodys or tower..Wouldnt that also be stealing from the music industry also????I know of instances where kids who dont have alot of money go and buy used cds then copy and return thecd to get another used cd....now arent in effect used record stores now becoming a "NAPSTER" of sorts.....Since you can go get for a small fee a cd copy it and bring it back..this facilitates file sharing Just the internet is not used to get said music...The cost of the used cd plus the return of it is maybe 3 dollars per cd....now all you are doing is eliminating your monthly High speed bill of 50dollars....Now lets chew on that one....

The 'rights' of the artist are 'sold' within the purchase of the Original CD....the local rights of 'fair use' pertain to the copying of that CD for purpose of backup....when the original is stolen, so too is stolen your rights to the backup.

I say 'local rights' as 'fair use' is encompassed within US Copyright/s but not, for example in Australian Law.

Purchase of second hand 'originals' is the same as giving a CD as a present to a third party.....the first purchase is where the royalties are 'included'.  Subsequent transactions don't attract royalty.

The burnt copy is specifically personal use for the purchased copy holder....the latter is stolen then the former becomes intrinsically illegal to continue to hold...

Dude give it up to Jafo!!!!!, it sucks but you are right..The problem will lay in who will feel more questionably right or wrong..If they ever came to me to prosocute on burnt copies of cds I had purchased I would tell them to bite me...But I Know I purchased them therfore i FEEL ITS MY RIGHT TO HAVE A COPY...However if you totalled up all the cds taken from me by ex girlfriends and other people my cd collection would be about a thousand if not more..I have a Vynil collection of over 2000 plus records, and for some reason no one wants to steal them..even though I purchase 'New Realese records"...I have turntables and a mixer..So 12inches is my perfered medium anyways...But no one ever takes my records..My whole house could up and be emptied and they would probably leave the records..They have before in the past....

I would use orginials as backup and use the copies. That way, if the copies got stolen it's still illegal for thief, not that he or she cares.

One thing that surprises me is that there is little if any mention of other types of illegal files being shared. (Like programs and movies) There was a thread not long ago about two kids comments who said the place to get PS was kazaa. They need to be more aggressive about getting pirates of other types of files, not just music.

That's the only possible solution to this. Sueing 1000's of people will only intimidate...not solve.


Actually it will force all of those who hate authority to use P2P more... (I personally do not use P2P)

Keep the originals locked in a safe so that your proof that you purchased the music can never be stolen from you.

It wont end, the users that are arrested are the 'sharers' the people who share the music and let other people download it. The 'downloaders' will never have to pay anything, they simply claim that they didn't know it was 'the' original track, and tought it was a parody or something...
