Found old Nintendo theme suites, need them to be upgraded

Tuesday, March 4, 2014 by Weboh | Discussion: WinCustomize Talk

So I found these old Nintendo Theme Suites:They are complete, with sound replacements, wallpapers, IconPackager, the works. There's 6 more: Zelda: Windwaker, Super Mario Sunshine, Pikimin, GameBoy Advance SP, Star Fox Adventures, and Eternal Darkness . They're beautiful, but only problem is they're for Windows 95-XPSP1. I'd like to be able to use them on my Windows 7 without the corruptions that happen by using old themes with new OS's. If you want these and the other themes to make compatible, I'll give them to you. Even after being made compatible, a few of them could use some touching up. Hopefully we can get an experienced group together to make these shine once again!

Weboh you just don't appear to want to accept what is being explained to you, which is your right.   I would of thought that based upon what you were told here you would have come to the conclusion that folks in this community are not willing to go against copyright rules.

As for myself, I don't really care one way or the other what folks may decide to or not to do, we all have to live with our own decisions.

Weboh
unfortunately we are not able to grant such request.

treetog
I cannot give you any kind of permission for doing that

Weboh
under the relevant laws of the particular jurisdiction involved
meaning Treetog.

You could only make/modify the skin for yourself with no distribution.

Otherwise....NO.

Now I like your use of 'I', 'us' and 'we' in your reply.   Just out of curiosity what responsibility are you willing to accept under a scenario where the updates are done and Nintendo does decide to take action?

Pardon my opinion but what part of NO do you not understand? The N or the O. Just sayin'

Don't get smart. Everyone's saying we can't do it because Nintendo would sue, and I'm saying they won't. After what I said above, can you honestly say you think they would sue?

Know what.....go ahead and do your thing but bear in mind any difficulties arising from it are on you alone. No one here is willing to go there.

If Apple can do it so can Nintendo, so the answer is 'Yes'.

In all honesty, I've seen enough in this thread.  It has explicitly been said by the skin creators that you cannot do anything with their skin.

It's time to respect that, or find the door.

Nobody, and I mean nobody is going to modify these skins for your use Weboh. Would somebody with common sense please lock this thread now? Thanks.

Everything has a 'bottom line'.

In this case, whether or not the Copyright holder has indicated an intent to vigorously pursue their rights the original artist's [Pixtudio] representative [treetog] has indicated that permission would be needed, and since both Alexandrie and treetog [and their company - Pixtudio] are ALL valued members of the International Skinning Community their rights and/or wishes will be vigorously protected by anyone/everyone with such in their capacity.

No reputable site or individual within the skinning community can or will condone the mis-appropriation or violation of their property rights.

I don't think I can spell it out any more clearly....

Then does anyone want to make any based on these? You know, not using the original files or anything? So that it's not "illegal"?

Same problem here even if you don't use the original files I believe.  If it would appear to be a copy or knockoff of the original skin then I believe it would still be in violation of the coypright rules.  In other words what is the intent of the new skins, to bypass copyright rules?

If I'm wrong Jafo will correct me.

I don't think so. There's themes here based off of Windows XP Luna and Windows 2000, and those got by the copyright checks. Then again, I've been wrong before....

Themes based off an OS and themes based off of copyrighted characters make all the difference.

How? The OS and it's design are copyrighted too. And there are a whole bunch of themes here based off of copyrighted characters too; just search Mario and see how many results you get.

Any way you slice it guy it all comes down to the same thing. If that's what you want to do then so be it but......do not upload to Wincustomize, it will be rejected. Do it for yourself only!! Any fallout is on you. Period!

How?

Microsoft [and others - eg 3rd party software people such as Adobe, etc] have always considered skinners' use of their base graphics/images as an addendum to its original use - not a copyright abuse.

A Photoshop Dock Icon is simply a 'third party' extra which enhances the use of the product [via Dock access].

This is NOT ALWAYS the case.

When Apple was about to release OSX a Windowblind pre-empted them which enabled Windows users to have the appearance of the Mac OS before even the Mac users.  Apple issued a cease and desist - and all the sites hosting the work complied.

The first such instance I can recall was pre Wincustomize.com ...on skinz.org....

Then again, I've been wrong before....

Yep.
