Guess where your wallpaper is........

Friday, November 23, 2001 by digitaljames | Discussion: WinCustomize Talk

This guy has/is posting walls from just about every half-arsed artist on the net. Dangeruss, Boxxi, Mobius, Misery, Shadowness, Digitalblasphemy, Adni18, Tech13, Shinter....flattering I suppose but no permission has been sought nor is Artist credit given less text in the wall itself.

Good point david, maybe we should follow Layne's lead and put a highly visible warning on our front page?

There's always the possibility that he hasn't dicovered Layne's work yet.

Oh my, I know this page for such a long time now... Didn't know, he doesn't have any permission... The site is really almost a "who is who" in wallpapers... I was a bit confused, when I saw the sountox-wallpaper there yesterday... Hmmm...

OK....the tattoo is actually my 'Jafo' man as seen in my WB screenshots.
Although I like XP as an OS, I'm not entirely mad....

Pity the site is such a large, well managed repository of stolen art though...

As long as he's not claiming to be the author of the walls, I'd hesitate to call him a thief... Misguided fan would be more like it

Did you notice in that site, that the "Sputnik" wallpaper by Nuvem, has been converted to Windows XP wallpaper!

There are 12 of my wallpapers there, hmm, at least not all.

Ok all, I do not know who has contacted the webmaster for the site, but I did and here is what we worked out.

I took the time to go through his galleries, and then listed all the images that where mine, I then sent him the nickname, email and url to apply to those images. He is going to go ahead and put the information up and section things off to list them as my works, as it should be. I found this to be a very fair solution to the problem, and think that it is something that benefits both him and me. He has put together a very high quality gallery and has a high exposure in a lot of ways, so for some other artist it may be a good idea to work out a similiar arrangement. Hell exposure work for us all.

Maybe I am wrong but I try to find a mutually beneficial solution to these things.

Oh I also directed him to this site and the msg thread so maybe he will come here and work things out with the rest of the community artists effected.

deviantART already has a (c) copyright "deviant" on all deviations though it probably needs to be a little clearer that the deviations cant be reposted elsewhere.

anyhow, i contacted the webmaster of the site in question letting him know what he was doing is wrong. here was his response to me (unchanged, exactly as he typed and formatted):

First, sorry for my bad english, I'm from France.. I know that I create wallpapers galeries of authors that I don't have their express authorisation, but to be honest, I didn't think it was a bad thing since I put the credits of the author, with a link to their homepage...
Also for your information, I don't make any money with this website, advertising (which is very very bad in this period) allow me only just to pay the dedicated server and the bandwith, which arevery expensive due to the hight traffic... I maintain this website just for the fun, and for the love of great pictures/wallpapers... You don't have to trust me, but it's really what I think..
I already receive some mails from various authors, and I always found a good arrangment with them.. If they absolutely want me to remove their work, i'll do it of course... but (and it's only my own opinion..) it's really a pity to miss a chance to diffuse great pictures to people who love that kind of work.. i think they create those pictures for that no ? not just only for them and the "digital art community" ...

Wasn't that Sputnik Wall with XP stuff a joke one by Nuvem in an attempt to win Nicole from Jafo?

Not sure who won in the end but I haven't heard from Nuvem in a while

Yes....'tis a pity he couldn't have posted something of mine that I had on DA....a nude or something, but not my joke wall.....come back to haunt me...

BTW, Nuvem 'thinks' he won Nicole, and I'm a nice guy so I won't disillusion him...

hello everybody,

I'm the (bad bad bad) webmaster of hebus.com...
Of so first i want to apologize for posting pictures without credits that were copyrighted, but i have to say for my defense that (like i already explained to MobiusCo) i took all those pictures from a free cd that i receive everymonth with a french video games magazine (called joystick) who put around 200-400 wallpapers every month without any author informations.. so I thought they was copyright free...
Now what do we do ? I suggest every person who see its work without credits on those galeries simply send me a mail with the names of the pictures, and if he want me to remove those pictures, or if i can create a specific galery with full credits (author name, email, url ...).
It's that ok with you ?
As i said on another mail, i just do this site for fun and love of great pics/wallpapers... i really don't want to have pb with that.. so tell me what i have to do, and i'll do it.. there's no problems...
(and sorry for my bad english too...it's hard to really say what you think in another language..)

Hebus2....
Thankyou for your sincerity and willingness to solve this little problem. It is commendable...
Heaven only knows how some French Video Game magazine ended up with some of these walls, especially mine, which was only on this site for a matter of days, but I guess they were one of the 'massive downloaders' who were taking everything.

Pity they had this one.....could you please remove it?
It is not intended as a 'serious' wallpaper, and is intentionally of poor quality...

For those interested in the on going events, I have worked out and agree ment with hebus that is beneficial to us both. As I think a few other artists have.

As for the primary source of this problem, Joystick magazine, I have located the parent website and emailed the editor, along with the person in charge of the cd content. I will keep you informed of the events. For those interested in contacting them yourself about your own works here is the URL:
