If someone posts, lets say, Icons in the DesktopX objects section. Is permission needed to use these objects? Just a little curious...

DesktopX is different. You can use other people's objects without permission as long as they remain original and the author info is still in there. But if You alter them in any way, You have to ask for permission.

Not sure, why would you have that right, the creator has the 'creator rights', anyway, to make sure there are no missunderstandings, I would contact the creator.

(for example, with winstyles you LINK to the skin, witch isn't violating the rights, with DX you ADD the skin.)

Yah...I thought dx was different too...I thought if you uploaded an object you were basically giving permission to use them in a theme as long as you didnt take credit for someone elses work.

That was my understanding as well... just curious, I saw a remark in the comments section of ... (well, it looks like Old Sapphire pulled the object that he put in the DX Objects section... ) that prompted me to ask this question in the first place..

He used someones icons (which are in the Objects section). The author posted in the comments section that he needed to ask permission before using them.

I have a feeling you are talking about me here... I generally freely give permission to use the Anytheme DX icon packs in people's uploaded themes if they only ask first, and include a author credit in their description. However when an author doesn't ask permission, and doesn't even say from who he got the objects from... I get a little annoyed. As you can imagine, when a person puts alot of work into a huge effort such as that, and then someone else takes credit, that's not right.

As far as the DesktopX Objects section not requiring permission before being used by a third-party, I will need to check on that. If that is this site's policy, then I will have to re-think my objects being available on this site.

I really do try and be a nice guy here. It's just good practice to follow this advice when involving anyone else's work: "When in doubt, ask!"

I was just curious on the policy.. i thought I saw in the description that he said the objects were made by you...
No big thing, I just wanted to make sure that when/if I use someones objects in the future that I do need to ask permission even though it is in the objects section.. PS - Love your stuff

In the rules section... it states


Ownership: You own the materials you upload. This cuts both ways, we assume you made what you uploaded and we will not sell your property without your permission. You must not only own what you submit but the subcomponents of it unless you have permission from the owners of the property you are submitting. For instance, DesktopX objects are designed to be used in other people's themes. It is assumed that when you upload a DesktopX object that you are giving permission to others to use them in their themes and they can therefore upload a theme that includes your DesktopX object without permission.
If you upload something that is owned by someone else or contains materials owned by someone else, we have the right to delete that item without notification. For instance, if you upload a wallpaper with the Lord of the Rings logo and the owners of that logo come to us and request we remove it, we will do so. Or if you upload a WindowBlinds skin, of some operating system, and the OS vendor requests we remove it, we will do so.

So having read this, I guess it clarifies the issue.. You do NOT need to ask permission to use an object that is uploaded to the objects section.

Any artwork I include in my objects and/or themes that is not public domain ALWAYS has prior permission from the original author.

I used Chad's icons in my Warehouse theme but most certainly asked his permission first. Any of Martin's objects that I modified were given his blessing first. Same with Judge's or anyone else's work.

I don't care what the rules at WC say, protocol and respect would say the right thing to do is ask first.

It's just the right thing to do.

Perhaps the "Rules" section should be updated and/or clarified somewhat.
