Copyright Infringement

There seems to be quite a few walls posted in this album from the wallpaper galley here at WC including several of mine, Skinhits RedneckDude Devjit and others. Is this kosher? I cannot seem to be able to figure out who has posted these images. Can you guys and girls be of some help?

Who does the site belong to?

Did anyone give permission to publish them? They are credited appropriately, but if you didn't give specific or blanket permission, I would think bad manners at least are involved, Frankief.

As for kashrut (kosherness)...there are many dietary laws and I don't think it violates any of them...(just trying to take the sting out of it, my friend...not making light of misappropriations - which I get upset about).

Any redistribution, not authorized by the Artist is Copyright infringement, and is actionable against those offering the items illegally.

Funny, I clicked on the link and the first thing I see is my wallpaper "91".. I don't recall uploading it here, in fact I didn't! Any one know how to find the site owner?

I agree...and that would appear to be the case from what Frankie wrote in the OP. Just trying to ease the sting a bit. The infringement upsets and angers me. Those artists worked hard and their rights shouldn't have been infriged upon.

Also, "The Refuge" seems to have a commercial angle...

Using WHOIS at networksolutions will tell you the owner of the domain, who you can then try to contact.  Good luck with it, I've had entire web sites (1000s of pages) stolen by Eastern European sites and kids before. Unless you can prove economic harm and/or their ISP is cooperative you often have very little legal recourse unfortunately.

If you look through thier wall gallery it looks like they randomly ripped the WC gallery.

I did notice that there is one by tailsgirl that I have never seen before and it's for sure it didn't come from here. Perhaps it's a clue.

Just had a look at this site and it reads like a who's who of WC. No sign of my stuff there - ah jeez am I that undesirable? On a more serious note some of their links concern sites that Site Advisor flags as Yellow - possible adware, spyware etc. so use caution if you decide to explore.

Sorry, had to run off and do some laundry but appreciate the replies. I know I did not give my permission for the posts that are mine but, as I said, I don't know how to find out who is posting the images. I did notice the new one by Tailsgirl. I thought keeping the names with the images was odd also.

Pobably not......remember she was ranting about her submissions being rejected here. And I know she was uploading at DA (removed since). I would guess she is getting ripped like the rest of you.

This site is reporting its newest registered user is Frankief. Very fishy this. Definitely a WC ripoff. Site has been around since November 2008 if not before.

It appears that none of the wallpaper images available on your site has been uploaded there with the consent of their owner/author.

It is a violation of artists' copyright to copy and/or distribute someone's work/s without specific consent. Posting their names [giving credit] is NOT sufficient and does NOT release you from culpability.

I would strongly suggest you withdraw any and all images uploaded without consent until such time as consent is requested AND granted.

Please do not be confused as to why/how such sites as Wincustomize.com [from which many of these images appear to have been taken] or Deviantart.com, etc. appear to be doing similar. The images uploaded to those sites are done so specifically by their owners....at their discretion and under their on-going control. [they can remove them as and when they see fit].

Your apparent methodology will likely expose you to potential litigation at worst and public condemnation at best and is thus highly advisable to address at the soonest opportunity.

On behalf of your valued employee [2of3] I humbly request you revise his work schedule as he finds the current demands both tiresome and draconian.  Further more, a recalibration of his pay-scale would be in order.  Might I suggest a 20% reduction in hours combined with a 50% increase in the hourly pay-rate?

Failing that, you can always sack the lazy sod.
