DesktopX Lotto Software? (Icon Rip?)

I was browsing around softpedia's games section when I noticed a familiar looking icon. I followed the links to the developers site Link trying to get a better look at the icon. Am I mistaken or is that one of the old DesktopX icons? [img="http://www.lotto-007.com/lotto007-lottery-software.html"]">

Obviously not only are people stealing the programs for free, they are taking the icons and other graphics also :/.
I speak out of NO knowledge on the subject however, just my point of view. I have seen a few threads talking about rips of other peoples skins, and icons, and thing of that nature.
I think people should ask permission when doing this. But I never had the first desktop X (or anything earlier than a 2.x version) so I am not sure if its the real deal or not.
Meh, I'll shut up now before I get flamed for saying things that may not be entirely true

Well, I have the impression that icons in software is often "borrowed". More often in Shareware apps.
