What about getting permission from the private producer?

As long as the clips used from it are within the "fair use" rules, permission would not be required.

Of course if the author is known, it's always best to contact them prior to use and besides, it's the right thing to do.

A torrent doesn't necessarily mean it's illegal/pirated.  I read somewhere recently that a site called Mininova is hosting files for people who are small time owners/producers of various kinds of media.  The idea is to help them gain exposure by making their works available to the public via torrent.  If that is the case with this particular video, and the IP owner is also the torrent owner, then it is legitimate.

Well I'm just guessing here, but do you need permission for just a 10 second clip of an hour video? Wouldn't producers get tired of processing every gif request on the net?

Keep in mind all shots seen here have a 5 - 35 second still shot aka perfectly loopable.

For the record I'm more picky about clarity then probably anyone on this board. Esp being a photographer.

Also, When searched by  themovie title all that come's up is torrents. I cannot find one place that actually sells the DVD. I think this was intented to be a free shared production.

More than likely, an advert for thier resort.

I'll check it out and see what I can do with it.

Once I get it downloaded, I'll see what I can do on posting some "Fair Use" Dreams from it.

I will also contact them for permission to post some other than fair use...I feel certain that if it's an advert for a resort, they would be happy to have some exposure to bring in the tourists.

1) No, a torrent doesn't per definition define it's content as 'illegal'.

2) Up untill only a few weeks ago Mininova was one of the largest illigal torrent sites on the web.

Unless you are the creator of the video or have permission from the original creator, I'm affraid you cannot use more than 25% (I think it is), though max 15 seconds (total) of the whole video.

A video (or any content for that matter) for 'free download/use' doesn't necessarily mean that the user can re-destribute it.

Seem's like it. Resorts have the highiest quality pictures as well. I always get their photos for my backgrounds as well.

As far as liscencing, i only want to use it for personal not commercial. I only want 4 minutes or so out of the whole 1 hour video anyways.

Permission is only needed if you want to share it with others.

As I understand it, torrent technology was originally designed/intended to move/download larger than average files more quickly by breaking it down into smaller, more managable pieces.  For example; although they opted not to use it, Microsoft could have used a torrent client to distribute the publice betas of Vista and Win 7.  I guess, though, like any other technology, there will always be somebody who will find a way to use it for illicit means.

That may have been so, but the piece I read said that Mininova now only hosts content uploaded/provided by the IP owner.  It seems that quite a few up and coming musicians, as well as those tired of the mainstream recording industry are using torrents to distribute their tunes... as do independent film makers and those not contracted to major studios. Sounds like a brilliant idea to me, artists gain exposure and the public gets to see/hear content and talent it might otherwise miss.

via Skype or ICQ, if there would be any problems with the permission of making it public.

Torrents are intended for 'large' files.  The most commonly torrented large files are Movies and Games.  Almost all [but not entirely all] are not the property of the distributor to distribute.

It is called theft.

There currently is a 22 year old who has a debt of 1.5 MILLION dollars [plus 100 thousand costs] to Nintendo for making a Mario Bros game available [even before release].

Private individual....stupid idiot.

He now has a debt that will ruin his life.....not bad for 22.

I wonder if they ever got the person at Nintendo who made it possible for that 22 year old to even do that? Wonder what his fine would be?

Apparently the game had been distributed to the shops...but there was to be a specific release time....one shop sold it early....he bragged online he already had it but people didn't believe him...so he uploaded it to prove his story.  It recorded about 50,000 downloads which Nintendo [and the court] could demonstrate as a loss of income/profit.

Stupid is as stupid does. Nintendo wasn't too bright distributing it without a sales date. A real Einstein must have figured that one out....like, "How fast will this game get stolen?".  Well guess what?  Turns out something does exceed the speed of light in a vacuum (of common sense).....

I love this one.
