Judging by the extract from their terms of use page below, they claim to understand copyright laws. I think they need to take another look at the laws!

but how can you decide on who gets to download what?
its very true that it is in no way fair on the authors of who's work is being ripped but banning Joe Public from certain downloads will have a drastic affect on the site will it not?

Might I suggest you employ a more capable legal team?
Firstly, Posting ANYTHING by author 'unknown' is a clear indication that NO permission was granted to you for displaying/distributing their works or images.
That is a clear and open admission of copyright violation.
This thread at Wincustomize.com is in part a verification of your failing/s.

In particular, BoXXi [Bryan Cook], a fellow Administrator of Wincustomize.com states he gave no permission to you to host/display his wall images.
That yet again is a clear verification of copyright theft.
The author of a work retains full rights to its use and public distribution unless otherwise agreed.
I have been a Professional working in the graphics industry for 30 years. I know and understand International copyright law.
I suggest you do likewise.
Be aware that each and every work on Wincustomize.com is and has been uploaded/submitted there by its author and thus remains within that author's copyright control.
This is clearly not the policy at macoszone.com .
Unless you and your site treats graphic artists and their inherent rights with the appropriate respect you will be ostracised from that community...either by reputation and/or by ISP instruction.
